1. Agreement and eligibility
By accessing or using Speek, you agree to these terms. If you use Speek for an organisation, you confirm that you have authority to bind that organisation. You must be legally able to enter a contract and provide accurate account information.
2. The service
Speek provides tools for configuring and operating voice agents, including calling, transcription, knowledge retrieval, workflow actions, reporting, and integrations. Features may differ between a public demo, pilot, and production deployment. We may improve or change the service while preserving material contracted commitments.
3. Accounts and access
You are responsible for protecting account credentials, limiting access to authorised users, and promptly telling us about suspected misuse. Activity performed through your account is treated as authorised unless you notify us of a security issue.
4. Customer responsibilities
You are responsible for:
- the legality and accuracy of instructions, knowledge, contacts, phone numbers, and other content supplied to Speek;
- providing required notices and obtaining consent for calls, automated communications, transcription, and recording;
- configuring human escalation and review for sensitive, regulated, or high-impact workflows;
- honouring opt-outs, suppression requests, calling-hour rules, and other communication restrictions; and
- reviewing the agent before directing production traffic to it.
5. Acceptable use
You may not use Speek to break the law, deceive or harass people, impersonate a person without authority, place unlawful unsolicited calls, collect prohibited secrets, bypass consent or suppression controls, interfere with the service, distribute malware, or develop a competing model through unauthorised extraction. We may suspend activity that creates legal, security, safety, or operational risk.
6. AI and automated actions
Voice and language models can misunderstand speech, generate inaccurate content, or behave unexpectedly. Speek should not be the sole basis for medical, legal, financial, employment, eligibility, emergency, or similarly high-impact decisions. You must define appropriate limits, permissions, testing, and human review for your use case.
7. Fees and payment
Fees, included usage, implementation work, billing frequency, taxes, and payment terms are set out on the pricing page, proposal, or order form accepted by the customer. Usage beyond an included allowance may be charged at the agreed rates. Except where law or an order form says otherwise, paid fees are non-refundable.
8. Customer data and intellectual property
You retain ownership of content and data you provide. You grant Speek the limited rights needed to host, process, transmit, and secure that data to provide the service. Speek retains ownership of its software, designs, models, documentation, and service improvements. Feedback may be used without restriction or an obligation to compensate you.
9. Privacy and confidentiality
Our Privacy Policy explains how personal data is handled. Each party will protect the other's non-public business, technical, and commercial information and use it only for the service or agreement, except where disclosure is legally required.
10. Third-party services
Speek relies on and may connect to third-party telephony, speech, model, hosting, authentication, messaging, and customer systems. Their availability and separate terms may affect connected features. You are responsible for third-party accounts that you choose to connect.
11. Suspension and termination
You may stop using Speek at any time, subject to an order form. We may suspend or terminate access for material breach, non-payment, unlawful use, security risk, or harm to the service or others. On termination, outstanding charges remain due and data is handled under the agreement and Privacy Policy.
12. Service disclaimer and liability
To the extent permitted by law, the service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Speek is not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, data, or goodwill. Any aggregate liability limit and exceptions will be defined in the applicable order form and mandatory law.
13. Changes, law, and contact
We may update these terms and will identify the effective date. Material changes will be communicated where required. The governing law, dispute process, notices, and contracting Speek entity for a paid deployment will be stated in its order form. Questions can be sent to support@speek.com.
